These Terms & Conditions govern your use of gwynethlewin.co.za (the "Site") and any purchase you make from us. Please read them before ordering. They are written to comply with the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and nothing in them limits any right those Acts give you.

1. Who We Are

1.1. Gwyneth Lewin is a sole proprietorship owned and operated by Lynda Gwyneth Jaros, trading as Gwyneth Lewin.

1.2. Address: Johannesburg, Gauteng, South Africa.

1.3. Email: hello@gwynethlewin.co.za  |  Telephone: +27 67 441-9747

1.4. Website: gwynethlewin.co.za

1.5. We sell hand-made leather laptop totes for women, crafted to order in South Africa. Each product page describes the bag, its materials and its dimensions.

2. Prices and Payment

2.1. All prices are shown in South African Rand (ZAR) and include VAT where applicable. The price you pay is the price displayed on the Site at the time you place your order.

2.2. Delivery is free within South Africa. International delivery is charged at R1 500. The full amount payable, including any delivery charge, is shown to you before you confirm your order.

2.3. We currently accept payment by bank transfer (EFT) only. Our banking details are provided on your order confirmation and in the confirmation email. Please use your Order ID as the payment reference.

2.4. We do not accept card payments and do not collect or store card details.

3. Placing an Order

3.1. Before you finalise your order you will be able to review the entire transaction, correct any errors and withdraw from it, as required by section 43(2) of ECTA.

3.2. By placing an order you make an offer to buy. A binding agreement comes into existence when we confirm your order in writing.

3.3. We may decline an order where the product is unavailable, where there has been an obvious pricing or description error, or where payment does not clear. If we decline your order we will tell you why and refund any amount you have paid in full.

3.4. You will receive a written record of your transaction by email, which you can save or print.

4. Making and Delivering Your Bag

4.1. Every TekTote is hand-made to order. We begin crafting your bag once your order is confirmed and payment has cleared.

4.2. Production takes approximately 3-4 weeks, after which delivery takes a further 5-7 days. By placing your order you agree to this delivery period for the purposes of section 46 of ECTA.

4.3. If we cannot meet the agreed period we will contact you. You may then agree a new date with us or cancel the order for a full refund.

4.4. Delivery requires an adult signature. Risk in the bag passes to you on delivery.

4.5. Full details are set out in our Shipping Policy.

5. Cancellation, Returns and Refunds

5.1. You may cancel free of charge before production begins, and in any event within 48 hours of placing your order.

5.2. Because you are buying online, section 44 of ECTA also gives you 7 days from receiving your bag to cancel for any reason and without penalty. You bear the direct cost of returning the bag.

5.3. Section 56 of the CPA gives you an implied warranty of quality for 6 months from delivery. If your bag is defective within that period, you choose whether we repair it, replace it or refund you, and we bear the cost of return.

5.4. These rights, and how to exercise them, are set out in full in our Returns & Refunds Policy, which forms part of these Terms.

6. Product Descriptions and Images

6.1. Because every bag is cut and stitched by hand from natural full-grain hide, small variations in grain, colour and markings are inherent to the material and are not defects.

6.2. Colours may render differently on different screens. If a bag differs materially from its description, that is a defect and section 5.3 applies.

7. Use of This Site

7.1. The content of this Site is provided for your personal use. You may not copy, modify, distribute, license or sell any material from it without our written consent.

7.2. If you create an account, you are responsible for keeping your password confidential.

8. Intellectual Property

8.1. All content, trade marks, logos, artwork and print designs on this Site belong to Gwyneth Lewin or its licensors. The prints applied to our bags are original artworks and may not be reproduced.

9. Liability

Please read this section carefully. It limits our liability in some circumstances, and we draw it specifically to your attention as required by section 49 of the CPA.

9.1. Nothing in these Terms excludes or limits our liability under section 61 of the CPA for harm caused by supplying unsafe or defective goods, including death, injury, illness, or loss of or damage to property. That liability cannot be contracted out of and we do not attempt to do so.

9.2. Nor do we exclude liability for fraud, or for anything else that South African law does not permit us to exclude.

9.3. Subject to 9.1 and 9.2, we are not liable for loss that was not reasonably foreseeable, or for loss arising from your failure to care for the bag in the ordinary way.

9.4. We are not responsible for delays caused by events genuinely beyond our control, such as courier disruption or natural disaster. Where that happens, section 4.3 applies.

10. Privacy

10.1. We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013. Please see our Privacy Policy.

11. Complaints and Dispute Resolution

11.1. Please contact us first at hello@gwynethlewin.co.za. We aim to acknowledge complaints within 2 business days.

11.2. If we cannot resolve the matter, you may refer it to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission, at no cost to you.

11.3. Referring a complaint does not affect your right to approach a court.

12. Changes to These Terms

12.1. We may update these Terms. Changes take effect when posted on this page and do not apply to orders already placed.

13. Governing Law

13.1. These Terms are governed by the law of the Republic of South Africa.

13.2. Disputes are subject to the jurisdiction of the South African courts. Nothing here prevents you from bringing a claim in the Magistrate's Court with jurisdiction over your area.
